General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter "General Conditions") govern the offer and sale of products through the website petitetunique.it (hereinafter "Site").

Please read these General Conditions carefully before proceeding with any purchase. Placing an order on the Site implies full and unconditional acceptance of these terms.

Art. 1 – Corporate Information and Site Ownership

The Site is exclusively owned and operated by PETIT ET UNIQUE, a sole proprietorship legally established under Italian law.

Art. 2 – Subject of the Contract and Scope of Application

2.1. These General Conditions govern the distance purchase of baby/children clothing, textile accessories, and related products (hereinafter "Products") carried out via the telecommunications network on the Site.

2.2. Sales are governed by the provisions of the Italian Consumer Code (Legislative Decree no. 206/2005) protecting consumers and by the regulations on e-commerce (Legislative Decree no. 70/2003).

2.3. PETIT ET UNIQUE reserves the right to modify these General Conditions at any time. Any changes will be effective exclusively from the moment of their publication on the Site and will apply to orders sent subsequent to such publication.

Art. 3 – Product Features and Prices

3.1. The essential characteristics of the Products are presented within each product sheet on the Site. The images and colors of the products offered for sale might not perfectly correspond to the real ones due to Internet browsers, monitor calibration, or variations in handcrafted batches.

3.2. All sales prices of the Products indicated on the Site are expressed in Euros (€) and are inclusive of VAT and any other applicable tax.

3.3. The indicated prices do not include shipping and delivery charges, which are clearly calculated, highlighted, and summarized before the final submission of the order.

3.4. PETIT ET UNIQUE reserves the right to vary the price of the Products at any time without notice. It is understood that the Client will be charged the price displayed on the Site at the moment the order is placed, without taking into account any subsequent variations (increases or decreases).

Art. 4 – Methods of Concluding the Contract

4.1. To proceed with the purchase, the Client must fill out the order form in electronic format and transmit it following the guided instructions on the Site.

4.2. Prior to submitting the order, the Client will receive a summary containing the details of the selected Products, their price, chosen payment method, shipping times, and costs.

4.3. The sales contract is considered formally concluded and binding when PETIT ET UNIQUE sends an Order Confirmation Email to the Customer's email address. This email will contain a summary of the contract conditions, information about the purchased Products, and the order number to be used in all communications.

4.4. PETIT ET UNIQUE reserves the right to reject or cancel orders if:

  • There are macroscopical, obvious, and recognizable errors in the price displayed on the Site (prices clearly wrong compared to market value).
  • Products are unavailable due to temporary stock misalignment.
  • There are reports or suspicions of fraudulent activities. In such cases, the Customer will be promptly informed and will receive a full refund of any sums already paid, at no additional cost.

Art. 5 – Product Availability

5.1. The availability of the Products indicated on the Site refers to the actual availability at the moment the Customer places the order. This availability must, however, be considered purely indicative due to the simultaneous presence of multiple users on the Site.

5.2. In case of partial or total unavailability of the Product after the order confirmation, the Customer will be notified immediately via email. The Customer can then choose to wait for restocking (if planned), replace the item, or request the cancellation of the order with a corresponding refund.

Art. 6 – Transfer of Risk

6.1. Pursuant to art. 63 of the Italian Consumer Code, the risk of loss or damage to the Products, for reasons not attributable to PETIT ET UNIQUE, is transferred to the Customer only when the latter (or a third party designated by him and other than the carrier) physically takes possession of the goods.

6.2. However, the risk is transferred to the Customer upon delivery of the Product to the carrier if the latter was chosen by the Customer independently and not from among those proposed by PETIT ET UNIQUE during purchase.

6.3. Upon delivery by the courier, the Customer is required to check that the packaging is intact and not damaged or altered. Any damage to the packaging must be immediately contested to the courier by placing a written reserve of control on the delivery receipt.

Art. 7 – Limitation of Liability and Misuse of Products

7.1. PETIT ET UNIQUE assumes no liability for service disruptions due to force majeure, fortuitous events, or internet outages, if it fails to execute the order within the contract times.

7.2. PETIT ET UNIQUE cannot be held responsible for direct or indirect damage resulting from improper use, washing not in compliance with instructions, or inadequate care of the Products by the Customer (including, but not limited to: high-temperature wash of delicate fabrics, bleaching of colored garments, unauthorized tumble drying, or wear from accidental friction).

7.3. Since these are textile and handcrafted products, minor variations in stitching, small size tolerances, or the natural loss of softness/color after numerous washes due to normal wear or the use of aggressive detergents do not constitute product conformity defects.

Art. 8 – Processing of Personal Data (Privacy)

8.1. The Customer's personal data are collected and processed by PETIT ET UNIQUE, as Data Controller, for the sole purpose of executing the sales contract, managing payments, and shipping products.

8.2. Data processing takes place in full compliance with the European Regulation (GDPR 2016/679) and current national legislation.

8.3. Data necessary for shipping will be communicated exclusively to partner carriers (Poste Italiane, InPost) and payment platform managers (Stripe, Klarna). The Customer can consult the full privacy policy at any time on the Site.

Art. 9 – Complaints and Dispute Resolution (ODR)

9.1. Any complaint relating to the purchase of a Product on the Site must be sent in writing via email to: info@petitetunique.it. PETIT ET UNIQUE undertakes to reply within 5 working days.

9.2. Pursuant to Art. 14 of EU Regulation no. 524/2013, the Consumer Customer is informed that they can submit complaints via the ODR (Online Dispute Resolution) platform provided by the European Commission for out-of-court dispute resolution: https://ec.europa.eu/consumers/odr/.

Art. 10 – Severability Clause

10.1. These General Conditions constitute the entire agreement between the Customer and PETIT ET UNIQUE regarding purchases made on the Site.

10.2. If one or more provisions of these General Conditions is deemed null, void, unlawful, or ineffective by a competent court, such invalidity will not affect the validity of the remaining clauses, which will continue to have full force and effect. The invalid clause will be replaced by a valid provision that best reflects the original intent.

Art. 11 – Intellectual Property

11.1. All trademarks (including the "Petit et unique" brand), logos, images, photos, texts, product descriptions, and software codes on the Site petitetunique.it are the exclusive property of PETIT ET UNIQUE and are protected by copyright and industrial property laws.

11.2. Reproduction, duplication, copying, selling, or any commercial exploitation of the Site content without the express written consent of PETIT ET UNIQUE is strictly prohibited.

Art. 12 – Applicable Law and Jurisdiction

12.1. These General Conditions are governed by Italian law.

12.2. For any dispute regarding validity, interpretation, or execution of the contract, if the Customer is a Consumer, the mandatory territorial jurisdiction belongs to the court of the place of residence or domicile of the consumer, if located in Italy.
